Terms of Service

These terms are an agreement between you and Radiant Spaces ("we", "us"), the operator of Radiant Toolkit (the "Service"), a web application for landscape lighting businesses to build estimates, proposals, and as-built records. By creating an account or using the Service you agree to them. If you are using the Service on behalf of a company, you confirm you are allowed to bind that company, and "you" means the company.

1. Your account

You need an account with a working email address to use the Service. You must confirm that address from the link we email before the account can sign in. Keep your password private; you are responsible for what happens under your account. Tell us at support@radiant-toolkit.com if you believe it has been used without your permission.

An account belongs to one company. An administrator of that company can invite other people to it, change their roles, and remove them. Everyone in a company can see the company's data.

2. Your content

Everything you put into the Service — your fixture library, estimates, proposals, job records, photos, your company's details and your clients' details — is yours. We do not claim ownership of it and we do not sell it. You give us only the permission we need to store it, process it, back it up, show it back to you and your team, and turn it into the documents you ask for.

You are responsible for your content: for having the right to upload it, including your clients' information and any photos, and for keeping it lawful. We may remove content that is illegal or that breaks these terms, and we will tell you if we do unless the law prevents it.

3. Acceptable use

Do not use the Service to break the law, to send spam, to store or distribute malicious software, to try to reach another company's data, to probe or overload our systems, or to resell access without our agreement. Do not create accounts with addresses that are not yours. We may suspend or close an account that does any of these.

4. The Service

We work to keep the Service available and your data safe: it is hosted with reputable providers, protected by encryption in transit, backed up every night, and monitored. Even so, the Service is provided as is. We do not promise it will be uninterrupted or error-free, and we may change or add features over time. Where we can, we will give notice of changes that remove something you rely on.

You can download a complete copy of your company's data at any time from Settings. We encourage you to keep your own copy; it is the only one you control.

5. Fees

The Service is currently free to use. If we introduce paid plans we will tell you in advance, and nothing you have already stored will be held back from you while you decide.

6. Ending the agreement

You can stop using the Service at any time. An administrator can delete the company from Settings, which permanently removes the company's data and the accounts that belonged only to it. Our backups age out within thirty days of that.

We may suspend or end your access if you break these terms, if the law requires it, or if we shut the Service down; in the last case we will give at least thirty days' notice and a way to export your data.

7. Liability

To the fullest extent the law allows, we are not liable for indirect, incidental, special or consequential damages, or for lost profits, revenue or data, arising from your use of the Service. Our total liability to you for any claim is limited to the amount you paid us for the Service in the twelve months before the claim, or one hundred US dollars if you paid nothing. Some jurisdictions do not allow these limits, in which case they apply as far as they can.

8. Governing law

These terms are governed by the laws of the State of New York, without regard to its conflict-of-law rules, and any dispute will be brought in the courts of that state.

9. Changes to these terms

We may update these terms. If a change is material we will email the administrators of every company at least fourteen days before it takes effect. Continuing to use the Service after that date means you accept the change.
